Introduction

CaptureAge provides services for watching and analysing video games.

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using this website, the CaptureAge desktop application (the “Application”) or any other products or applications associated with our services (collectively, the "Service") operated by CaptureAge ("us", "we", or "our").

Your agreement with us includes these Terms and our Privacy Policy (collectively, the “Agreements”).

By subscribing or otherwise using the Service you acknowledge that you have read and understood the Agreements, accept the Agreements and agree to be bound by them. If you don’t agree or cannot comply with the Agreements then you may not use the CaptureAge Service.

Changes to the Agreements

From time to time we may make changes to the Agreements. We will notify you of any changes by updating this page.

In the case of material changes we will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the "effective date" at the top of these Terms.

Continued usage of the Service constitutes your acceptance of the changes. If you do not want to accept the new Agreements then you may terminate your account by contacting us.

Payments, cancellations and trials

When you sign up you must provide us with information that is accurate and complete, and you must keep this information up to date. Failure to provide us with accurate and complete information may cause your account to become inaccessible, and for us to be unable to provide support or refunds of any fees paid.

Access to and use of the Application is granted only through an active Subscription and applies only for the duration of the Subscription. Different Subscription Levels (also called Reward Levels) may grant you access to different features or rights. Subscriptions may be Paid or Unpaid.

A Paid Subscription lasts for one calendar month, but you may choose for your subscription to recur automatically, in which case you authorise CaptureAge to charge you automatically each month until you cancel. You may cancel this recurring subscription by contacting CaptureAge or by turning off recurring payments on your profile page. Cancellations will take effect the day after the last day of the current subscription period, unless they are in the Cooling Off Period, in which case they take effect as soon as they are processed.

If you purchase a Paid Subscription you may cancel this subscription at any time, for any or no reason, during the first 14 days after you first signed up for the service (the “Cooling-Off Period”) for a full refund of any fees paid to CaptureAge. Subsequent subscriptions will not be eligible for the Cooling Off Period. To cancel a Paid Subscription and receive a refund during the Cooling Off Period please contact us.

You may change your Subscription Level at any time. If your new Subscription Level has a higher fee than your current Subscription Level then you will be charged a prorated fee to cover the remainder of your current billing period, and your new Subscription Level will begin immediately. If the new Subscription Level has a lower fee than the current Subscription Level then your new Subscription Level will begin at the start of your next billing period.

CaptureAge will not refund any fees if you cancel or change your subscription at any time other than during the Cooling-Off Period.

We may change the price charged to qualify for different Subscription Levels. Price changes will take effect from the beginning of the next subscription period following the date of the price change. We will notify you at least 30 days before increases to the price of your subscription and you may reject the change by cancelling your Subscription prior to the change taking effect.

Community Pool

When subscribing for a Paid or Unpaid Subscription you have the option to donate to the Community Pool. These donations are used exclusively for funding community events and projects, like show matches, tournaments and other projects. They will not be used to fund development and support of the CaptureAge service itself.

We will provide full details of how Community Pool donations are used on this website as and when they are used.

Licensing

The Service and the associated applications are the property of CaptureAge. We grant you a limited, non-exclusive, revocable permission to use the website.

We grant you a limited, non-exclusive, non-transferable, revocable permission for the duration of your Subscription to make personal, non-commercial use of the Application. We also grant you a limited, non-exclusive, revocable permission for the duration of your Subscription to make commercial use of the Application by creating and/or distributing live or pre-recorded footage of your use of the Application. We do not grant you permission to use the Application for any other commercial use. If you are not sure whether your commercial usage of the Application is allowed then please contact us.

You agree to abide by our user guidelines (see the “User Guidelines” section). The Application or any other parts of the Service are not sold or transferred to you and CaptureAge retains ownership of all copies of all CaptureAge software applications.

You may only use the Application on a limited number of devices, as specified by your Subscription Level. You may change which devices your permission applies to, but we may limit how frequently you can change your device(s).

Except for the rights expressly granted to you in these Agreements, we do not grant any right, interest or title to you in the CaptureAge Service or any associated software application.

User guidelines

You must own a legal copy of Age Of Empires II in order to use the Application.

You agree not to, and you will not permit others to:

  • license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or make the Application available to any third party;
  • use the Application in violation of any applicable laws, rules or regulations;
  • remove, alter or obscure any proprietary notices (including those relating to copyright or trademarks) of CaptureAge or other licensors of the Application;
  • reverse engineer, decompile or disassemble the Application, except and only to the extent permitted by law despite this limitation;
  • use the Application for any commercial enterprise or revenue generation (with the exception of the commercial use explicitly permitted above) or any other purpose for which it was not designed or intended;
  • work around any technical limitations in the Application

Term and Termination

The Agreements shall remain in effect until terminated by you or CaptureAge.

CaptureAge may terminate these Agreements with or without prior notice, including in the event of your non-compliance with the Agreements.

You may terminate the Agreements by contacting CaptureAge.

Upon termination of the Agreements, you shall cease all use of the Application and delete all copies of the Application from your devices.

Warranty disclosure

The Service is provided on an “as is” basis. CaptureAge disclaims all warranties about the Service to the fullest extent permitted by law.

Limitation

The Service is provided on an “as is” basis. CaptureAge will not be liable for any general, special, incidental or consequential damages arising from or in connection with your access or use, or inability to access or use, the Service.

Severability

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
